These Terms explain how our Website works, how purchases are handled and the important details that keep everything running smoothly.

These Website Terms & Conditions ("Terms") govern your access to and use of this Website and your purchase of products offered through it.
For the purposes of these Terms:
"TIMBAR," "TIMBAR," "we," "our," and "us" refer to TIMBAR Technologies Corp., a corporation incorporated under the laws of British Columbia, Canada, and a subsidiary of Arney 2015 Ventures Inc.
By accessing the Website, browsing its content, creating an account, subscribing to communications, placing an order, submitting information, or otherwise using the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms and any policies referenced herein.
If you do not agree with these Terms, you should discontinue use of the Website immediately.

- any domain names, subdomains, landing pages, country-specific websites, mobile experiences or online properties owned or operated by TIMBAR Technologies Corp. that link to or reference these Terms; and
- all purchases made through those properties.

Each policy forms part of your agreement with TIMBAR.

While we make reasonable efforts to ensure accuracy, we do not guarantee that product descriptions, specifications, compatibility information, photographs, videos, pricing, availability or other content are complete, current or error free.
Product images are intended for illustration purposes only and may differ slightly from the final product.
TIMBAR reserves the right to correct errors, update information or modify content at any time without notice.
7. Product Information & Compatibility
TIMBAR products are aftermarket accessories designed for use with compatible powered pole saws.
Customers are solely responsible for verifying compatibility before purchasing, installing or using any TIMBAR product.
Unless expressly stated in writing, TIMBAR does not guarantee compatibility with any specific manufacturer or model.
Product specifications, dimensions, materials, colours, packaging, accessories and features may change without notice as products continue to evolve.
8. Orders
Submitting an order does not guarantee acceptance.
TIMBAR reserves the right to:
- refuse any order;
- limit quantities purchased;
- cancel an order;
- discontinue any product;
- refuse service to any customer where permitted by law; or
- correct pricing, typographical or technical errors.
If an order is cancelled after payment has been processed, any applicable refund will be issued using the original payment method.
9. Preorders
Certain products may be offered for preorder.
Estimated shipping dates are provided for convenience only and are estimates, not guarantees.
Manufacturing delays, supplier issues, transportation disruptions, customs delays, labour shortages, weather events or other circumstances may affect delivery schedules.
Customers may cancel preorder purchases prior to shipment in accordance with our Shipping Policy.
10. Pricing & Payment
Prices displayed on the Website are shown in the applicable storefront currency and may vary by region.
Taxes, shipping charges and other applicable fees will be calculated during checkout where applicable.
TIMBAR reserves the right to modify pricing without prior notice.
Obvious pricing errors may be corrected even after an order has been submitted.
Payment processing is provided through third-party payment providers. TIMBAR does not store complete payment card information.
11. International Orders
Customers are responsible for ensuring that TIMBAR products may be legally imported into their jurisdiction.
Unless otherwise stated, customers are responsible for any applicable:
- customs duties;
- import taxes;
- brokerage fees;
- value added taxes;
- tariffs; or
- other government charges.
For shipments to the United States, applicable duties and tariffs will be handled in accordance with the checkout process and current shipping policies.
12. Acceptable Use
You agree not to:
- violate applicable laws;
- interfere with Website operations;
- introduce malicious software or code;
- attempt unauthorized access to systems or accounts;
- copy or scrape Website content using automated methods;
- impersonate another person or organization;
- interfere with another user's experience; or
- use the Website for unlawful or fraudulent purposes.
TIMBAR may suspend or terminate access to the Website for violations of these Terms.
13. Accounts
If you create an account, you are responsible for:
- maintaining the confidentiality of your credentials;

- all activity occurring under your account.
You agree to notify TIMBAR promptly if you suspect unauthorized access to your account.
14. Intellectual Property
Unless otherwise indicated, all intellectual property rights relating to the Website and TIMBAR products, including but not limited to:
- copyrights;
- product designs;
- manuals;
- graphics;
- photographs;
- videos;
- logos;
- marketing materials;
- software;
- trade dress;
- website design;
- text; and
- other proprietary content,
are owned by Arney 2015 Ventures Inc. or used under license by TIMBAR Technologies Corp.
TIMBAR branding and related marks may be the subject of pending trademark applications in multiple jurisdictions.
Patent applications relating to TIMBAR products and technology may also be pending.
Nothing contained on this Website grants any ownership interest or licence to use any intellectual property except as expressly permitted by law.
No content may be copied, reproduced, modified, republished, distributed, reverse engineered or commercially exploited without prior written permission.
15. User Content & Feedback
If you voluntarily submit reviews, testimonials, photographs, videos, comments, suggestions, ideas or other content to TIMBAR, including by tagging TIMBAR on social media, you grant TIMBAR a worldwide, perpetual, irrevocable, royalty-free, transferable licence to use, reproduce, publish, display, adapt, modify and distribute that content for business, marketing, educational and promotional purposes.
You represent that:
- you own or have permission to submit the content;
- the content does not infringe the rights of any third party; and
- the content is accurate to the best of your knowledge.
TIMBAR is under no obligation to publish or compensate you for submitted content unless otherwise agreed in writing.
Products provided to influencers, ambassadors or creators do not create any ongoing obligation or relationship unless governed by a separate written agreement.
16. Product Safety
TIMBAR products are designed for use with powered cutting equipment.
Improper installation, operation or maintenance may result in serious injury, death or property damage.
Every user agrees to:
- read the complete TIMBAR instruction manual before installation or use;
- read and follow the original equipment manufacturer's instructions for the compatible powered pole saw;
- inspect equipment before each use;
- use appropriate personal protective equipment; and
- operate products only in accordance with applicable laws and safe operating practices.

17. No Professional Advice
Information provided on this Website is intended for general informational purposes only.
Nothing contained on the Website should be interpreted as engineering, arboricultural, forestry, legal or professional advice.
Users remain solely responsible for determining the suitability and safe use of any product.
18. Disclaimer of Warranties
Except as expressly provided in the TIMBAR Warranty Policy or required by applicable law, the Website and its contents are provided on an "as is" and "as available" basis.
TIMBAR disclaims all warranties, representations and conditions, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.
19. Limitation of Liability
To the fullest extent permitted by applicable law, TIMBAR, TIMBAR Technologies Corp., Arney 2015 Ventures Inc., their directors, officers, employees, contractors and affiliates shall not be liable for any indirect, incidental, consequential, special, exemplary or punitive damages arising from or relating to:
- use of the Website;
- inability to access the Website;
- use or misuse of any product;
- installation or compatibility issues;
- lost profits;
- lost data;
- business interruption; or
- property damage.
Where liability cannot legally be excluded, TIMBAR's maximum aggregate liability shall not exceed the amount actually paid by the customer for the applicable product giving rise to the claim.
Nothing in these Terms excludes rights that cannot legally be excluded under applicable consumer protection legislation.
20. Indemnification
You agree to indemnify and hold harmless TIMBAR Technologies Corp., Arney 2015 Ventures Inc. and their affiliates from any claims, liabilities, losses, damages, costs or expenses arising from:
- your violation of these Terms;
- your misuse of the Website;
- your misuse or improper installation of TIMBAR products; or
- your violation of any law or third-party rights.
21. Third Party Services
The Website may rely upon third-party providers for hosting, security, analytics, communications, payment processing, content delivery, marketing and shipping services.
TIMBAR is not responsible for the content, availability or privacy practices of third-party websites or services.
22. Force Majeure
TIMBAR shall not be liable for delays or failures resulting from events beyond its reasonable control, including natural disasters, pandemics, labour disputes, supplier failures, transportation disruptions, governmental actions, cyber incidents or utility outages.
23. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein.
Any legal proceedings arising from these Terms shall be brought before the courts of British Columbia, Canada.
24. Severability
If any provision of these Terms is determined to be unenforceable, the remaining provisions shall remain in full force and effect.
25. Changes to These Terms
TIMBAR may update these Terms from time to time.
Updated versions become effective upon posting to the Website unless otherwise stated.
Continued use of the Website after changes are posted constitutes acceptance of the revised Terms.
